This is important: This Employer Agreement (“Agreement”) contains important information about your legal rights, remedies, and obligations, and is a legally binding agreement between you (“you” or “Employer”) and Asian Bloom Consultancy FZE. (“Asian Bloom,” “we”, or “us”). You understand that by using the Asian Bloom website and by clicking accept when prompted on the website, you agree to be bound by all agreements which constitute Asian Bloom’s Terms and conditions.

If you don’t understand this Agreement or you don’t agree to all of its terms and conditions, you may not use our Services. The agreement explicitly requires the Employer to consent to its terms by clicking accept, establishing a clear method of acceptance.

1.1 REGISTRATION

You must register for an account to have full access to our Services, and your registration is subject to our approval.

Your Account registration is subject to approval by Asian Bloom. You can be requested to upload company documents such as the trade license/business card/owner documents or interior design photos of workplace. This will contribute to granting your company a verified status and enhance its credibility. Kindly note that these documents are exclusively used for verification purposes. By agreement, Asian Bloom is bound to maintain strict confidentiality concerning any information pertaining to companies and is prohibited from disclosing said information to any third parties. Within the scope of its obligations, Asian Bloom undertakes to solely utilize publicly accessible information and reliable sources for the purpose of verifying any company profile.

Asian Bloom reserves the right to decline a registration either to join Asian Bloom or to add an Account of any type, for any lawful reason, including supply and demand, lack of credibility, or other business considerations. Asian Bloom ensure that its refusal to register accounts is non-discriminatory and compliant with equality laws.

Employer retains the flexibility to modify profile and requirements for Candidates at any time. Please note that the history of amendments will be securely saved in our website for reference. In the event of any disputes or conflicts, resolution and management will be based on the application and its details as of the same date when the interview takes place.

1.2 ACCOUNT ELIGIBILITY

You promise to use our Services for business purposes only. You also promise that you are eligible to enter into this Agreement, including because you are 18 years or older.

Asian Bloom offers the Services for your business purposes only and not for personal or consumer use. By registering for an Account or by using our Services, you represent that you: (a) are doing business under your own name as a self-employed individual/sole proprietor or are an employee or agent of an independent business (such as a corporation, limited liability company, or other entity); (b) will use our Services for business purposes only; (c) will comply with any licensing, registration, or other requirements with respect to your business, or the business for which you are acting, and (d) are either a legal entity or an individual who is at least 18 years old, and that you can form legally binding contracts.

1.3 ACCOUNT PROFILE

You must provide accurate personal information when you sign up and you must update your Account if your staffing requirements are changed. We can suspend or terminate your Account if the information you give us is false, outdated, or incomplete.

To register for an Account to use our Services, you must complete Registration (“Registration”), which you consent not to be shown to the public. You agree to provide accurate and complete information on your Profile—and on all registration and other forms you access while using our Services or provide to us—and you agree to keep that information current. You agree not to provide any false or misleading information about your identity or location, your business, the beneficial owner(s) of your business, or the services your business provides, and you agree to correct any information that is or becomes false or misleading. We reserve the right to suspend or terminate the Account, or access to our Services, of anyone who provides false, inaccurate, or incomplete information in creating Account.

1.4 IDENTITY AND LOCATION VERIFICATION

You will allow us to verify your identity, location, and business affiliations from time to time.

When you register for an Account and periodically thereafter, your Account will be subject to verification, including but not limited to validation against third-party databases or the verification of one or more official government or legal documents that confirm your identity, your location, and your ability to act on behalf of your business on Asian Bloom. You authorize Asian Bloom, directly or through third parties, to make any inquiries necessary to validate your identity, your location, and confirm your ownership of your business, email address or financial accounts, subject to applicable law. When requested, you must timely provide us with complete information about yourself and your business, which includes providing official government or legal documents, and cooperating with other reasonable requests we make to verify your identity. During verification some Account features may be temporarily limited but will be restored if verification is successfully completed.

2.1 RELATIONSHIP WITH ASIAN BLOOM

2.1.1. OUR SERVICES

Asian Bloom provides an online platform that connects Employers and Candidates within the beauty industry to facilitate official employment opportunities based on defined matching criteria. Asian Bloom operates strictly as an intermediary platform and does not participate in, supervise, or influence any contractual, financial, or employment decisions made between the parties. Asian Bloom is not a recruitment agency and don’t act as a recruiter.

Asian Bloom offers a platform that enables Employers and Candidates in beauty industry to find one another, enter into official employment contacts and agreements, receive and provide Services based on matching business criteria. You acknowledge and agree that Asian Bloom does not supervise, direct, control, check qualification or monitor Candidates in the performance of any contractual obligations they may have under Direct Contract and agree that: (a) Asian Bloom is not responsible for ensuring the accuracy or legality of any Candidate Content, for which Candidates are solely responsible; (b) Asian Bloom is not responsible for the offering, performance, or procurement of Services, (c) Asian Bloom does not make any representations about or guarantee any particular Candidate’s offered services, and (d) Asian Bloom is not responsible for background, customer service skills, professional experience, communication talents, health condition, reputation of Candidates.

You further acknowledge and agree that you, and not Asian Bloom, are solely responsible for (a) evaluating and determining the suitability of any Candidate; (b) assessing whether to enter into employment Contract with Candidate and identify period and conditions of the Contract, as well as verifying any information about Candidate, including employment history and references. All Service and Employment Contracts are directly between you (“Employer”) and Candidate, and Asian Bloom is not a party to those contracts. Asian Bloom only can provide business recommendations and suggestions to Employer if it is requested.

As a reminder, Asian Bloom uses sophisticated technology in our matching process and strictly adheres to the principle of non-interference. This means that the number of potential interviews you, as an Employer, may receive will solely depend on the matching criteria established by the Candidates. Asian Bloom's technology is designed to objectively match qualified Candidates with Employers based on their specific requirements, ensuring a fair and efficient matching process.

Asian Bloom does not guarantee interviews, hires, employment outcomes, or the suitability or performance of any Candidate. Use of the platform does not guarantee successful recruitment or employment.

2.1.2. THIRD-PARTY AND AGENCY DISCLAIMER

At present, Asian Bloom does not cooperate with any external recruitment or intermediary agencies. Some agencies may attempt to register on behalf of Employers or Candidates, request modifications to terms, or demand separate payments. Asian Bloom is not a party to any such arrangements or conditions.

All official fees and payment procedures are defined exclusively by Asian Bloom and are transparently listed in the “Prices” section of the website for public verification.

Should any Employer or Candidate decide to engage with an external agency, this is done solely at their own discretion and responsibility.

2.1.3. INTERVIEW CONCEPT; CONFIDENTIALITY COMPLIANCE POLICY

Asian Bloom provides a secure technological tool that enables Candidates and Employers to communicate directly through the platform.

All communication conducted through the platform is automatically recorded and stored within Asian Bloom’s secure system. The technology continuously monitors activity to identify and flag any violations of platform rules or inappropriate behavior. This process ensures transparency, accountability, and compliance with data protection and privacy standards.

Employer agrees that prior to entering into a Employment Contract, you (a) will use Asian Bloom as the sole manner to communicate with other Candidates; (b) will not provide your Means of Direct Contact to any other Candidates or another person that you identified or were identified by through the website or during the interview; (c) will not use Means of Direct Contact of Candidate to attempt to or to communicate with, solicit, contact, or find the contact information of Candidate outside of Asian Bloom; (d) will not ask for, provide, or attempt to identify through public means the contact information of any Candidate; and (e) will not include any Means of Direct Contact or means by which your contact information could be discovered in any profile, proposal, job posting, invitation, or pre-hire communication through the website’s communications services, except as otherwise provided on the website.

“Means of Direct Contact” means any information that would allow another person to contact you directly, including, without limitation, phone number, email address, physical address, a link to a contact form or form requesting contact information, any link to an applicant management system or means to submit a proposal or application outside of the website, or any information that would enable a user to contact you on social media or other website or platform or application that includes a communications tool, such as Instagram, WhatsApp, Telegram, Facebook, Slack, WeChat, Zalo, Max or similar. Information is a Means of Direct Contact if it would enable another user to identify any of the information above through other sources, such as going to a website that included an email address or identifying you through social media.

You acknowledge and agree that a violation of these terms is a material breach, and your Account may be permanently suspended for such violations.

2.1.4. VISA, IMMIGRATION, AND SPONSORSHIP DISCLAIMER

Asian Bloom does not provide visa, immigration, sponsorship, relocation, medical insurance, or work permit services and makes no representations regarding the eligibility of any Candidate for employment visas or permits. All immigration, visa, sponsorship, and employment authorization matters are the sole responsibility of the Employer and the Candidate.

3.1 FEES FOR EMPLOYERS AND HIRING PROCEDURE

1. Candidate Search and Matching

To access Candidate profiles and start inviting Candidates for interviews, the Employer must first create a Company Profile and publish a Vacancy on the platform. Once the Vacancy is published, the Employer becomes visible to Candidates and may search for Candidates in two ways: manually through SearchLIVE using advanced filters and criteria, or through the AI Matching mechanism, which provides faster and more accurate Candidate recommendations based on the Vacancy requirements.

2. Interview Process

The Employer may arrange interviews with selected Candidates through the platform. Each interview shall have a duration of twenty-five (25) minutes.

Interview fee: 50 AED / SAR (~14 USD) per interview. The number of interviews is not limited and shall be determined solely by the Employer.

3. Job Offer

Following the interview stage, the Employer may issue a Job Offer to the Candidate through the platform.

The Candidate shall have the right to accept or reject the Job Offer or to request amendments. The Employer may revise and resend the Job Offer at its discretion.

4. Hiring Confirmation Fee

Upon acceptance of the Job Offer by the Candidate, the Employer shall be required to pay a hiring confirmation fee through the platform in order to confirm its intention to proceed with employment.

Standard hiring confirmation fee: 1,000 AED / SAR (~ 272 USD).

Promotional hiring confirmation fee: 500 AED / SAR (~136 USD), subject to active promotions announced on the platform.

5. Access and Direct Communication

Upon successful receipt of the hiring confirmation fee, the Employer shall receive full access to the Candidate’s complete profile and contact details. At this stage, the hiring process on the platform shall be deemed completed, and both parties may continue communication directly outside the platform.

3.1.2. PAYMENT METHODS.

Currently, payments can be made online through Stripe. Stripe is a secure and globally trusted payment platform that supports various methods, including credit and debit cards. It ensures fast, reliable, and protected transactions, offering both Candidates and Employers convenience and confidence when making payments.

Stripe also supports multiple currencies (AED, SAR, USD, EUR, and more) and works seamlessly across the Middle East, making it easy for users worldwide to complete their payments without complications.

3.1.3. PAYMENT TERMS

Client hereby authorizes Asian Bloom to run credit card authorizations on all credit cards provided by Client, to store credit card and banking or other financial details as Client's method of payment consistent with these Terms and Conditions, and to charge Client's credit card (or any other Payment Method) for the platform fees and any other amounts owed under these Terms and Conditions. To the extent permitted by applicable law and in accordance with these Terms and Conditions, you acknowledge and agree that we may use certain third-party vendors and service providers to process payments and manage your payment method information. Asian Bloom does not store full credit card details directly on its systems; all payment data is handled securely by our third-party payment processors. Asian Bloom shall not be liable for any errors, failures, or breaches occurring on the part of such third-party payment processors.

3.2. VAT AND OTHER TAXES

As a UAE-based company, Asian Bloom operates in accordance with the laws and regulations of the UAE.

Any payments made within the UAE will be subject to a 5% VAT on the provided services. However, for international transactions, VAT will not be applied.

Kindly note that there might be a slight variance in the amount due to any potential bank charges incurred during the transaction.

4. REFUND

Employers may submit refund requests only with clear and verifiable supporting evidence. All refund requests are subject to review, and Asian Bloom reserves the sole right to approve or reject any request at its discretion.

4.1. INTERVIEW FEES

Interview fees are refundable only in cases where a scheduled interview could not be conducted due to verified technical or connectivity issues, including platform malfunction, internet failure, or connection disruption, which prevented the interview from taking place. The Employer may submit a refund request through the “My Payments” section within three (3) calendar days from the scheduled interview date. All interviews are recorded and reviewed by Asian Bloom for verification purposes. Following verification, the refund request shall be either approved or declined at Asian Bloom’s discretion, and the Employer shall be notified of the decision by email, including the reason for approval or rejection.

4.2. EMPLOYMENT FEES

The Employer may request a refund of the employment fee only in the following cases, provided that clear and explicit documentary evidence is submitted for validation via email or WhatsApp within three (3) calendar days from the occurrence of the event: a) the Candidate fails to appear upon arrival or does not commence employment; b) the Candidate is unable to proceed with employment due to medical reasons, supported by an official medical report; c) the Candidate is officially reported as absconding during the probation period, supported by an official absconding report.

Upon validation, Asian Bloom shall process the refund within the timeframe communicated to the Employer in writing.

4.3. NON-REFUNDABLE CASES

If the Employer no longer requires the Candidate’s services for any reason other than those listed in Clause

4.2 above, including internal decisions, business changes, or dissatisfaction after payment, all fees paid

shall be non-refundable.

4.4. REVIEW AND FINAL DECISION

Asian Bloom reserves the right to review each refund request, request additional documentation, and, where necessary, involve the Candidate in the review process. In the event of ambiguity or dispute, Asian Bloom’s determination shall be final and binding.

5. DISPUTES

You agree not to hold us responsible for any dispute you may have with any Candidate.

1) In recognition of the fact that Asian Bloom is not a party to any contract between Employer and Candidate, you hereby release Asian Bloom, our other Affiliates, and our respective officers, directors, agents, subsidiaries, joint ventures, employees from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with any dispute you have with another Candidate, whether it be at law or in equity that exist as of the time you enter into this Agreement. This release includes, for example and without limitation, any disputes regarding the performance, attitude, functions, and quality of the Candidate Services provided to Client and requests for refunds based upon disputes.

2) You acknowledge that Asian Bloom is not a party to any employment or service contract between Employer and Candidate and does not determine, approve, or control the type of engagement offered.

Any job offer or cooperation proposed by you — including but not limited to full-time, part-time, freelance, temporary, project-based, or any other contractual arrangement — is made solely at your discretion and responsibility and must comply with all applicable labor, employment, immigration, and regulatory laws, including the requirements of the relevant Ministry of Labour / Ministry of Human Resources in the country of operation.

A comprehensive contractual agreement incorporates an indemnification clause, whereby users expressly agree not to hold the platform liable for any violations of labor law that they may commit while utilizing the website and afterwards. This clause aims to protect the website from legal claims and demands arising from the actions or omissions of its users in relation to labor laws.

This Agreement shall be governed by and construed in accordance with the laws of the United Arab Emirates.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Asian Bloom’s total liability to the Employer shall not exceed the fees actually paid by the Employer to Asian Bloom in the twelve (12) months preceding the event giving rise to the claim, or AED 500, whichever is lower.

Asian Bloom shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of business opportunity, loss of revenue, loss of data, or reputational damage, whether arising out of contract, tort, or otherwise, even if Asian Bloom has been advised of the possibility of such damages. Asian Bloom does not warrant that the platform will be uninterrupted, errorfree, or free from viruses, and makes no representations regarding the accuracy or suitability of Candidate profiles or information for any particular purpose.

7. INTELLECTUAL PROPERTY

All content, trademarks, logos, software, technology, and other intellectual property on the Asian Bloom platform (“Asian Bloom IP”) are owned by or licensed to Asian Bloom Consultancy FZE and are protected under UAE Federal Law No. 36 of 2021 on Intellectual Property Rights. No part of the Asian Bloom IP may be copied, reproduced, distributed, or modified without prior written consent from Asian Bloom. The Employer is granted a limited, non-exclusive, non-transferable, revocable licence to access and use the platform solely for the business purposes set out in this Agreement.

Vacancy postings, company profiles, and other content submitted by the Employer to the platform (“Employer Content”) remain the property of the Employer, but the Employer grants Asian Bloom a nonexclusive, worldwide, royalty-free licence to use, store, display, and process such content solely for the purposes of operating the platform and providing the Services. Asian Bloom will not use Employer Content for any promotional or marketing purposes without prior written consent.

8. ACCOUNT SUSPENSION AND TERMINATION

Asian Bloom reserves the right to suspend or permanently terminate the Employer’s Account at any time without prior notice if: (a) the Employer breaches any provision of this Agreement; (b) the Employer provides false or fraudulent information; (c) the Employer’s conduct is harmful to the platform, Candidates, or Asian Bloom’s reputation; (d) the Employer engages in prohibited activity; or (e) required by applicable law or a competent authority. If terminated for a rule violation, the Employer may not register a new account using the same trade licence, email address, or mobile number.

The Employer may delete its Account at any time via the Settings section of the platform. Upon deletion, the Employer’s profile and all published vacancies are removed from public access and account access is disabled. Any outstanding payment obligations remain due and payable notwithstanding account deletion.

Asian Bloom may retain certain limited information after account deletion where required for legal compliance, fraud prevention, dispute resolution, security purposes, or enforcement of platform policies.

9. AMENDMENTS TO THIS AGREEMENT

Asian Bloom reserves the right to amend these Terms and Conditions at any time. When changes are made, the Employer will be notified on the platform and required to accept the updated Terms and Conditions before continuing to use the Services. The Employer’s acceptance will be recorded with a timestamp. If the Employer does not accept the updated terms, it may delete its Account via the Settings section of the platform.

10. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the United Arab Emirates. Asian Bloom Consultancy FZE is a company registered in the UAE and subject to the applicable laws and regulations of the UAE.

Any dispute arising out of or in connection with this Agreement must first be submitted in writing to Asian Bloom at info@asianbloom.com. If the dispute is not resolved within thirty (30) days of the written submission, either party may refer the matter to the competent courts of the UAE, which shall have exclusive jurisdiction.

11. ACCEPTABLE USE AND PROHIBITED CONDUCT

The Employer agrees not to: (a) access or attempt to access any part of the platform, its servers, or systems without authorisation; (b) use automated tools, bots, scrapers, or crawlers to access or extract data from the platform without prior written consent; (c) launch or facilitate any form of cyberattack, including DoS, DDoS, SQL injection, or XSS attacks; (d) reverse-engineer, decompile, or tamper with any part of the platform’s software or technology; (e) introduce malware, viruses, trojans, ransomware, or any other malicious code into the platform; (f) post false, misleading, or fraudulent vacancy listings; (g) use the platform to discriminate against Candidates on the basis of race, gender, nationality, religion, disability, or any other protected characteristic in violation of applicable UAE law; (h) create multiple accounts to circumvent a suspension or ban; or (i) engage in any activity that violates applicable UAE cybercrime laws, including Federal Decree-Law No. 34 of 2021 on Combating Rumours and Cybercrime.

12. SEVERABILITY AND ENTIRE AGREEMENT

If any provision of this Agreement is found to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. This Agreement, together with these Terms and Conditions, constitutes the entire agreement between Asian Bloom and the Employer and supersedes all prior agreements and understandings. Any waiver by Asian Bloom of a breach of any provision of this Agreement shall not be construed as a waiver of any subsequent breach.
