This is important: This Candidate Agreement (“Agreement”) contains important information about your legal rights, remedies, and obligations, and is a legally binding agreement between you (“you” or “Candidate”) and Asian Bloom Consultancy FZE. (“Asian Bloom,” “we”, or “us”). You understand that by using the Asian Bloom website and by clicking accept when prompted on the website, you agree to be bound by all agreements which constitute Asian Bloom’s Terms and conditions.
If you don’t understand this Agreement or you don’t agree to all of its terms and conditions, you may not use our Services. The agreement explicitly requires the Candidate to consent to its terms by clicking accept, establishing a clear method of acceptance.
1.1 REGISTRATION
You must create a profile to have full access to our Services, and registration of your profile is subject to our approval.
Account registration is subject to approval by Asian Bloom. As part of the registration process, the Candidate is required to submit personal documents, including but not limited to a curriculum vitae (CV), photographs of the Candidate and of their professional work, certificates, and recommendation letters.
The purpose of submitting such materials is to obtain verified status and to enhance the credibility of the Candidate’s profile. All documents provided are used strictly for verification purposes and handled in accordance with Asian Bloom’s data protection and privacy policies.
For identity verification, the Candidate is required to upload an official identification document, such as a passport, national identification card, or driving license. The Candidate may obscure or cover the identification number or other sensitive information; however, the document must clearly display the Candidate’s full name and photograph to confirm identity.
Asian Bloom may, from time to time, request the Candidate’s consent to use photographs or work samples for promotional, marketing, or social media purposes. No such materials shall be published, distributed, or otherwise utilized without the Candidate’s prior explicit written consent.
Asian Bloom reserves the right to decline any registration or account request for any lawful reason, including but not limited to insufficient information, lack of credibility, or other business considerations, while ensuring that all such decisions remain non-discriminatory and compliant with applicable equality and data protection laws.
Candidate retains the flexibility to modify profile and requirements for potential Employers at any time.
Please note that the history of amendments will be securely saved in our portal for reference.
1.2 ACCOUNT ELIGIBILITY
You promise to use our Services for business purposes only. You also promise that you are eligible to enter into this Agreement, including because you are 18 years or older.
By registering for an Account or by using our Services, you represent that you: (a) will use our Services for recruitment purposes only; (b) an individual who is at least 18 years old, and that you can form legally binding contracts; (c) must have a clean criminal record, without any convictions for serious offenses or involvement in illegal activities that could jeopardize the safety or reputation of the Employer.
1.3 ACCOUNT PROFILE
You must provide accurate personal information when you sign up and you must update your Account if any requirements are changed. We can suspend or terminate your account if the information you give us is false, outdated, or incomplete.
To register for an Account to use our Services, you must complete Registration (“Registration”), which you consent not to be shown to the public. You agree to provide accurate and complete information on your Profile—and on all registration and other forms you access while using our Services or provide to us— and you agree to keep that information current. You agree not to provide any false or misleading information about your identity or location, contact information, your professional experience, references, portfolio, or the services you provide, and you agree to correct any information that is or becomes false or misleading. The use of artificially generated images, including but not limited to AI-created photos, or any photos that have been digitally altered or manipulated (e.g., through Photoshop or similar tools), is strictly prohibited. All uploaded photographs must accurately represent the Candidate’s real appearance and work. We reserve the right to suspend or terminate the Account, or access to our Services, of anyone who provides false, inaccurate, or incomplete information in creating Account.
1.4 IDENTITY AND LOCATION VERIFICATION
You will allow us to verify your identity, location, and professional portfolio from time to time.
When you register for an Account and periodically thereafter, your Account will be subject to verification, including but not limited to validation against third-party databases or the verification of one or more official documents that confirm your identity, your location and your qualification. You authorize Asian Bloom, directly or through third parties, to make any inquiries necessary to validate your identity, your location, email address or contact information. When requested, you must timely provide us with complete information about yourself and your contact information, which includes providing official documents, and cooperating with other reasonable requests we make to verify your identity. During verification some Account features may be temporarily limited but will be restored if verification is successfully completed.
2.1 RELATIONSHIP WITH ASIAN BLOOM
2.1.1. OUR SERVICES
Asian Bloom provides an online platform that connects Employers and Candidates within the beauty industry to facilitate official employment opportunities based on defined matching criteria. Asian Bloom operates strictly as an intermediary platform and does not participate in, supervise, or influence any contractual, financial, or employment decisions made between the parties. Asian Bloom is not a recruitment agency and don’t act as a recruiter.
Asian Bloom does not supervise, direct, control, or monitor Employers or Candidates in the execution of their agreements, nor does it verify or guarantee any aspect of their professional qualifications, background, or credibility. The responsibility for all due diligence lies exclusively with the Employer and the Candidate.
The Candidate is solely responsible for evaluating and determining the suitability of any Employer, reviewing the proposed employment terms, and verifying all relevant information, including feedback or references. All employment or service agreements are concluded directly between the Candidate and the Employer, and Asian Bloom is not a party to such agreements.
Asian Bloom provides general consultancy and guidance based on its professional experience in the beauty sector. This includes assisting in the facilitation of employment-related interviews and providing clarifications regarding market practices and commonly accepted employment procedures. Asian Bloom does not provide legal advice or representation and is not responsible for interpreting or enforcing government regulations. Candidates and Employers are solely responsible for verifying all employment terms, documentation, and compliance with the laws and regulations of the relevant country, including consultation with the Ministry of Labour or other official authorities where necessary.
Asian Bloom employs advanced AI-based technology to support the matching process and follows a strict policy of non-interference. The number of interviews or potential job opportunities received by the Candidate depends exclusively on the matching parameters established by Employers. The platform’s role is limited to facilitating objective, efficient, and transparent connections between both parties.
2.1.2. THIRD-PARTY AND AGENCY DISCLAIMER
At present, Asian Bloom does not cooperate with any external recruitment or intermediary agencies.
Some agencies may attempt to register on behalf of Employers or Candidates, request modifications to terms, or demand separate payments. Asian Bloom is not a party to any such arrangements or conditions.
All official fees and payment procedures are defined exclusively by Asian Bloom and are transparently listed in the “Prices” section of the website for public verification.
Should any Employer or Candidate decide to engage with an external agency, this is done solely at their own discretion and responsibility.
2.1.3. INTERVIEW CONCEPT; CONFIDENTIALITY COMPLIANCE POLICY
Asian Bloom provides a secure technological tool that enables Candidates and Employers to communicate directly through the platform.
All communication conducted through the platform is automatically recorded and stored within Asian Bloom’s secure system. The technology continuously monitors activity to identify and flag any violations of platform rules or inappropriate behavior. This process ensures transparency, accountability, and compliance with data protection and privacy standards.
Prior to entering into an Employment Contract, the Candidate agrees to communicate exclusively through the Asian Bloom platform. The Candidate shall not:
(a) share or request any Means of Direct Contact with Employers or third parties outside the platform;
(b) use any external tools or applications to communicate, solicit, or exchange personal or business information with Employers;
(c) attempt to identify or contact Employers through public means or social media; or (d) include contact details or any identifiable links within their profile, job proposals, or communication history.
For purposes of these Terms and Conditions, “Means of Direct Contact” refers to any information that enables direct personal communication outside the platform, including but not limited to: phone numbers, email addresses, physical addresses, links to contact forms, social media accounts, or any digital communication tool such as Instagram, WhatsApp, Telegram, Facebook, Slack, WeChat, Zalo, Max or similar.
Any violation of these terms shall be considered a serious violation of the platform’s policies and may result in immediate suspension or permanent termination of the Candidate’s Account.
3.1 FEES FOR CANDIDATES AND HIRING PROCEDURE
3.1.1. SERVICE FEES.
1. Categories of Candidates
There is one unified category of Candidates, regardless of their location. All Candidates may use Asian Bloom employment services free of charge.
Asian Bloom does not charge Candidates for:
- Vacancy search
- Applications
- Interviews
- Job offers
- Employment confirmation
All processing fees are payable exclusively by Employers.
Promotional Policy:
Asian Bloom reserves the right to introduce promotions, adjust Employer-side service fees, or temporarily provide certain services free of charge. Each promotion will have a defined validity period and will be officially announced on the platform.
2. Vacancy Search
The Candidate can search for vacancies in two ways: a) Independently, through SearchLIVE, by applying personal filters and criteria; b) By using our AI Search Assistant Asia and completing the Application Form. After submitting the Application Form, the AI Assistant immediately provides the best job recommendations with a visible match percentage, allowing the Candidate to save time in the search process.In both cases, the Candidate can apply for a vacancy, and the Employer will be notified of the Candidate’s request.
3. Interview Process
If the Employer is interested in the Candidate’s profile, the Candidate will receive a request for an individual 25-minute interview. The Employer shares their availability in the calendar, and the Candidate can select a suitable time slot.
4. Job Offer
If both the Candidate and the Employer consider the interview successful, the Employer is required to send a Job Offer to the Candidate. The Candidate has the right to accept or reject the offer by providing a reason for rejection. If the Employer accepts the Candidate’s comments and remains interested, the Employer may modify the offer letter and resend it. The Candidate retains the right to reject the updated offer and continue exploring other opportunities.
If the Candidate accepts the Job Offer, the Employer will be required to make a processing fee payment through the platform to confirm their intention to proceed with that particular Candidate.
5. Additional and Special Services
Asian Bloom provides optional additional services for Candidates, including but not limited to application or profile boosting, CV creation or optimization, customized notifications, educational seminars, and personal consultation services. These services may be offered on a complimentary or paid basis and are available in a separate “Special Services” section of the platform. All such services are strictly optional, do not guarantee employment, and do not influence Employer hiring decisions.
3.1.2. PAYMENT METHODS.
Currently, payments can be made online through Stripe. Stripe is a secure and globally trusted payment platform that supports various methods, including credit and debit cards. It ensures fast, reliable, and protected transactions, offering both Candidates and Employers convenience and confidence when making payments.
Stripe also supports multiple currencies (AED, SAR, USD, EUR, and more) and works seamlessly across the Middle East, making it easy for users worldwide to complete their payments without complications.
3.1.3. PAYMENT TERMS
Client hereby authorizes Asian Bloom to run credit card authorizations on all credit cards provided by Client, to store credit card and banking or other financial details as Client's method of payment consistent with these Terms and Conditions, and to charge Client's credit card (or any other Payment Method) for the platform fees and any other amounts owed under these Terms and Conditions. To the extent permitted by applicable law and in accordance with these Terms and Conditions, you acknowledge and agree that we may use certain third-party vendors and service providers to process payments and manage your payment method information. Asian Bloom does not store full credit card details directly on its systems; all payment data is handled securely by our third-party payment processors. Asian Bloom shall not be liable for any errors, failures, or breaches occurring on the part of such third-party payment processors.
3.2 VAT AND OTHER TAXES
As a Dubai-based company, Asian Bloom operates in accordance with the laws and regulations of the UAE. Any payments made within the UAE will be subject to a 5% VAT on the provided services. However, for international transactions, VAT will not be applied.
Kindly note that there may be a slight variance in the total amount due to potential bank charges or fluctuations in daily currency exchange rates at the time of the transaction.
4. REFUND POLICY
All payments for optional and Special Services, including educational content, CV creation or optimization, profile or application boosting, and related services, are non-refundable.
Private consultation sessions may be rescheduled or fully refunded if the request is made more than 24 hours before the scheduled consultation time. If less than 24 hours remain before the consultation, the payment is non-refundable and the consultation cannot be rescheduled. Consultations affected by verified technical issues on the platform side will be rescheduled. Missed or unattended consultations by the Candidate are non-refundable.
5. DISPUTES
You agree not to hold us responsible for any dispute you may have with any Employer.
In recognition of the fact that Asian Bloom is not a party to any contract between Employer and Candidate, you hereby release Asian Bloom, our other Affiliates, and our respective officers, directors, agents, subsidiaries, joint ventures, candidates from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with any dispute you have with another Employer, whether it be at law or in equity that exist as of the time you enter into this Agreement. This release includes, for example and without limitation, any disputes regarding the payment issues, attitude, functions, contract conditions, and requests for refunds based upon disputes.
A comprehensive contractual agreement incorporates an indemnification clause, whereby users expressly agree not to hold the platform liable for any violations of labor law that they may commit while utilizing the website and afterwards. This clause aims to protect the website from legal claims and demands arising from the actions or omissions of its users in relation to labor laws.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Asian Bloom’s total liability to you shall not exceed the fees actually paid by you to Asian Bloom in the twelve (12) months preceding the event giving rise to the claim, or AED 500, whichever is lower.
Asian Bloom shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of employment opportunity, loss of earnings, loss of data, or loss of goodwill, whether arising out of contract, tort, or otherwise, even if Asian Bloom has been advised of the possibility of such damages. Asian Bloom does not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components, and makes no representations regarding the accuracy, completeness, or suitability of any information or content on the platform for any particular purpose.
7. INTELLECTUAL PROPERTY
All content, trademarks, logos, software, technology, and other intellectual property on the Asian Bloom platform (“Asian Bloom IP”) are owned by or licensed to Asian Bloom Consultancy FZE and are protected under UAE Federal Law No. 36 of 2021 on Intellectual Property Rights and applicable international intellectual property laws. No part of the Asian Bloom IP may be copied, reproduced, distributed, modified, or used to create derivative works without prior written consent from Asian Bloom. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the platform solely for the purposes set out in this Agreement.
By uploading your CV, portfolio, photographs, or any other content to the platform (“Candidate Content”), you retain ownership of your Candidate Content but grant Asian Bloom a non-exclusive, worldwide, royaltyfree licence to use, store, display, and process such content solely for the purposes of operating the platform and providing the Services. Asian Bloom will not use your Candidate Content for any promotional or marketing purposes without your prior written consent.
8. ACCOUNT SUSPENSION AND TERMINATION
Asian Bloom reserves the right to suspend or permanently terminate your Account at any time without prior notice if: (a) you breach any provision of this Agreement; (b) you provide false or fraudulent information; (c) your conduct is harmful to the platform, other users, or Asian Bloom’s reputation; (d) you engage in prohibited activity; or (e) required by applicable law or a competent authority. If terminated for a rule violation, you may not register a new account using the same mobile number or email address.
You may delete your Account at any time via the Settings section of the platform. Upon deletion, your profile becomes invisible, your applications and interviews are removed from public access, and your account access is disabled. To use the platform again in the future, you will need to register a new account. Asian Bloom may retain certain limited information after account deletion where required for legal compliance, fraud prevention, dispute resolution, security purposes, or enforcement of platform policies, including prevention of repeated abuse.
9. AMENDMENTS TO THIS AGREEMENT
Asian Bloom reserves the right to amend these Terms and Conditions at any time. When changes are made, you will be notified on the platform and required to accept the updated Terms and Conditions before continuing to use the Services. Your acceptance will be recorded with a timestamp. If you do not accept the updated terms, you may delete your Account via the Settings section of the platform.
10. GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of the United Arab Emirates. Asian Bloom Consultancy FZE is a company registered in the UAE and subject to the applicable laws and regulations of the UAE.
Any dispute arising out of or in connection with this Agreement must first be submitted in writing to Asian Bloom at info@asianbloom.com. If the dispute is not resolved within thirty (30) days of the written submission, either party may refer the matter to the competent courts of the UAE, which shall have exclusive jurisdiction.
11. ACCEPTABLE USE AND PROHIBITED CONDUCT
The Candidate agrees not to engage in any of the following prohibited conduct: (a) accessing or attempting to access any part of the platform, its servers, databases, or systems without authorisation; (b) using automated tools, bots, scrapers, crawlers, scripts, or any similar technology to access, extract, or interact with the platform without prior written consent from Asian Bloom; (c) launching or facilitating any form of cyberattack, including but not limited to denial-of-service (DoS) attacks, distributed denial-of-service (DDoS) attacks, SQL injection, cross-site scripting (XSS), or any other attempt to disrupt, damage, or compromise the platform or its infrastructure; (d) attempting to reverse-engineer, decompile, disassemble, or otherwise tamper with any part of the platform’s software, code, or technology; (e) introducing or attempting to introduce malware, viruses, trojans, ransomware, spyware, or any other malicious code into the platform or its systems; (f) intercepting, monitoring, or attempting to access data transmitted through the platform by other users; (g) impersonating any person or entity, or misrepresenting your identity or affiliation; (h) creating multiple accounts to circumvent a suspension, ban, or any platform restriction; (i) using the platform or any data obtained through it to compete with Asian Bloom or to solicit other users for external services; or (j) engaging in any activity that violates applicable UAE cybercrime laws, including Federal Decree-Law No. 34 of 2021 on Combating Rumours and Cybercrime.
12. SEVERABILITY AND ENTIRE AGREEMENT
If any provision of this Agreement is found to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. This Agreement, together with these Terms and Conditions, constitutes the entire agreement between Asian Bloom and the Candidate and supersedes all prior agreements and understandings. Any waiver by Asian Bloom of a breach of any provision of this Agreement shall not be construed as a waiver of any subsequent breach.
